Notice on personal data protection

This document contains the main information concerning the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and regarding the repeal of Directive 95/46 / EC (General Data Protection Regulation) that must be brought to the attention of users of the website. Under these circumstances, Euro Contractor Ltd. informs users about their rights regarding personal data protection as well as the main ways of application of the provisions of the Regulation. The purpose of data collection is to provide the services available on euro-contractor.ro, therefore, the data collected will be used exclusively for the good conduct of the activities on the website, which you are aware of and for which you give your consent.

Data collected may be referring to: name, surname, email address, phone number, address. Providing us with your personal data is not mandatory but the lack of provision of these data may lead to the impossibility of performing some activities on the website. To sum up, you have the rights to access, to interfere with data, not to be subject to an individual decision, and the right to appeal to the courts. At the same time, you have the right to oppose the processing of your personal data and to request the deletion of the data. The details of these rights are reproduced further.

Therefore, according to art. 39 of the Regulation, Any processing of personal data should be lawful and fair. It should be transparent to natural persons that personal data concerning them are collected, used, consulted or otherwise processed and to what extent the personal data are or will be processed. The principle of transparency requires that any information and communication relating to the processing of those personal data be easily accessible and easy to understand, and that clear and plain language be used. That principle concerns, in particular, information to the data subjects on the identity of the controller and the purposes of the processing and further information to ensure fair and transparent processing in respect of the natural persons concerned and their right to obtain confirmation and communication of personal data concerning them which are being processed. Natural persons should be made aware of risks, rules, safeguards and rights in relation to the processing of personal data and how to exercise their rights in relation to such processing. In particular, the specific purposes for which personal data are processed should be explicit and legitimate and determined at the time of the collection of the personal data. The personal data should be adequate, relevant and limited to what is necessary for the purposes for which they are processed. This requires, in particular, ensuring that the period for which the personal data are stored is limited to a strict minimum. Personal data should be processed only if the purpose of the processing could not reasonably be fulfilled by other means. In order to ensure that the personal data are not kept longer than necessary, time limits should be established by the controller for erasure or for a periodic review. Every reasonable step should be taken to ensure that personal data which are inaccurate are rectified or deleted. Personal data should be processed in a manner that ensures appropriate security and confidentiality of the personal data, including for preventing unauthorized access to or use of personal data and the equipment used for the processing. Therefore, the website users have the following rights:

Right of access by the data subject

Any person wishing to gain access to the data processed by our company will submit a request for information regarding the purpose of processing your data by Euro Contractor Ltd. (if applicable), the recipients to whom the data are disclosed, the data subject to processing, information on the existence of data protection rights. In addition to the request, the application must include the following information: applicant identification data (name, first name, date of birth, place of birth, address, telephone, email), applicant identification documents (ID card or legal representation documents if applicable), the data to which access is requested, the email address to which the requested information will be transmitted (if electronic transmission is being used) or the location to which it is to be transmitted (if you opt for a hard copy transmission); statement on your own responsibility regarding the accuracy of the information provided in the application.

Right to rectification

Everyone has the right to request the rectification, completion or updating of personal data collected, owned or stored at Euro Contractor Ltd. Regardless of the type of request (rectification / completion, updating, our company will solve this request within 30 days), otherwise the applicant has the right to address The National Supervisory Authority For Personal Data Processing (NSAPDP) or to file an appeal.

Right to erasure (right to be forgotten)

In the following situations, Euro Contractor Ltd. will delete your personal data within 30 days of receipt of the request:

  • the data are no longer necessary for the purposes for which they were collected or processed;
  • the applicant withdrew the consent on the basis of which the processing took place;
  • the applicant opposes the processing of data under art. 21 (1) on the right of opposition (i.e. archiving purposes in the public interest, scientific or historical research or for statistical purposes);
  • where there are uncertainties about the lawfulness of the processing of personal data;
  • in case the data have to be deleted in order to observe a legal obligation for the operator;
  • in the case of personal data belonging to children under the age of 16.

Euro Contractor Ltd. will not delete the personal data collected and stored when the data processing is required for:

  • exercising the right to free expression and information;
  • compliance with a legal obligation;
  • reasons of public interest;
  • purposes of archiving in the public interest, scientific or historical research or for statistical purposes;
  • finding, exercising or defending a right to security.

Right to restriction of processing

Euro Contractor Ltd. will respect the right of the data subjects to restrict processing in the following situations exhaustively named by the Regulation as follows:

  • the data subject contests the accuracy of the data for a period that allows the operator to verify the accuracy of the data;
  • processing is illegal and the data subject opposes the deletion of personal data, but instead calls for restrictions on their use;
  • the operator no longer requires personal data for processing, but the data subject requests them to find, exercise or defend a right in court;
  • the data subject opposed to processing in accordance with Article 21 (1), for the period of time to verify that the legitimate rights of the controller prevail over those of the data subject.

Right to data portability

According to the Regulation, the data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where: processing is based on consent or on a contractual basis and the processing is carried out by automated means.

Thus, within our company, the right to portability of data is respected within the limits specified above and in the context presented (consent / contractual relations and exclusive electronic data processing). Data portability also refers only to the primary data that was collected and stored, and not to the possible results of the processing in which the personal data was used before the porting request.

Right to object

Euro Contractor Ltd. shall respect the right of any person to oppose the processing of his/her personal data in the context in which the exercise of this right will be through a written, dated, signed, and reasoned request. If the exercise of the right to object is opted for, Euro Contractor Ltd. will enable the option to delete personal data, unless data deletion is not allowed (as outlined above). The right to opposition will be immediately respected (without prior checking or restriction) if the processing involves direct marketing purposes, automatic profile creation, scientific or historical purposes.

Automated individual decision-making, including profiling

Euro Contractor Ltd. will use means of automatic data processing in the situations provided by the Regulation as follows:

  • when processing is required for the conclusion or performance of a contract to be concluded between our company and the individual concerned;
  • when automatic processing is authorized by law;
  • when automatic processing is based on the explicit consent of the data subject;
  • when a decision taken on an automatic processing does not have a legal or similar effect in a meaningful way on a person.

Right to withdraw consent

Euro Contractor Ltd. addresses the issue of withdrawal of consent in the context in which personal data are processed solely on the basis of prior consent, consent that can be withdrawn at any time. Withdrawal of consent leads to the automatic deletion of personal data, except for those situations in which data processing cannot cease for legitimate reasons of society (for example, for instance).

Right to lodge a complaint with the National Supervisory Authority for Personal Data Processing

Euro Contractor Ltd. will permanently inform the data subjects about the rights to the protection of personal data in accordance with the provisions of the Regulation, with the possibility for addition and updating / upgrading this material, therefore users having the obligation and the responsibility to periodically consult this section because the changes made are not announced or notified in any distinct way on the website.
